Property Tax Valuation Litigation
on Commercial Properties
Texas local governments are largely funded by
property taxes. This makes property taxes a significant cost of
doing business in Texas, particularly for property-intensive businesses.
The ability to challenge a property’s taxable valuation is tightly
controlled by Texas law, and there are many potential pitfalls
for the owner. Our lawyers have practiced for nearly twenty years
in the area of property tax litigation, giving us the ability
to handle virtually any aspect of this complex field. Our practice
emphasizes representation of commercial property owners. (We seldom
accept representation on residential valuation challenges.) While
most of our work is done at our standard hourly rates, our firm
will consider handling property tax litigation on a flat fee or
contingent fee basis, in appropriate cases, and within the discretion
of our attorneys. While each property--and every lawsuit--is unique,
and no particular results can be guaranteed, some representative
matters handled include: *
- Obtained
a judgment for an over seven million dollar value reduction
on a Galleria area office building. The client’s tax savings
for the years in issue were over Three Hundred Thousand Dollars
($300,000.00). The Court established the property’s value at
precisely the amount sought by the firm’s client, and awarded
the firm judgment against the Harris County Appraisal District
for all of the owner’s attorney fees in the lawsuit.
- Successfully
defended a lawsuit brought by the Harris County Appraisal District,
in which the District sought to radically increase the taxable
value of a large portfolio of apartment properties. The District
dismissed the lawsuit after the firm’s discovery demonstrated
that the District had not met the jurisdictional prerequisites
necessary to support its lawsuit.
- Obtained
a judgment, at trial, for an over five million dollar value
reduction on a Houston office building, with an attorney's fees
award.
- Negotiated
a settlement establishing the value of Harris County land at
less than two-thirds of the value set by the Harris County Appraisal
District, based on environmental regulations affecting the property.
- After
a tax agent was improperly refused a hearing before an appraisal
review board, filed an Application for Mandamus through the
Texas Court of Appeals; and obtained a hearing before the appraisal
review board, which in turn resulted in the value sought by
the owner.
* In every matter, the results obtained depend on the facts of the
case. Since every factual situation is different, past performance
is not a guarantee of future results |
